Sale of Property - Terms and Conditions


If a seller wishes Nekretnine Sunce d.o.o. to provide agency services for the sale of a property, our agent visits the property and inspects the documentation, and he agrees the price of the property and other details in connection with the sale with the seller. After that an agency contract is signed with the seller. If the seller agrees, we take photos of the property in order to be able to present it efficiently to potential buyers. If the papers are not complete, we assist the seller in obtaining the missing documents in order for the future buyer to be able to enter the ownership of the property to his name in the land register without any difficulties.

Nekretnine Sunce d. o. o. has an obligation:

- to diligently inform the Seller about agency opportunities with potential buyers,
- to conduct negotiations in order to reach an agreement on sale of the property,
- once the agreement is reached, to draft a preliminary contract and the sales contract,
- to organize certification of the seller's and buyer's signatures on the preliminary contract and the sale contract,
- our employee is present at the certification of the loan agreement at the notary public if the property is acquired by means of a housing loan,
- our employee is present during the payment of the sales price and the acceptance of the property, and on that occasion the Real Estate Acceptance Protocol is drafted.

For the agency services rendered Nekretnine Sunce d. o. o. charges a commission from the seller amounting to 1.5% + VAT of the agreed sales price on the territory of the City of Zagreb and the County of Zagreb and 2% + VAT for properties outside the City of Zagreb and the County of Zagreb. The commission is charged in full at the moment the advance deposit is paid, i.e. simultaneously with the conclusion of the Preliminary Contract on the Sale of Property or the Contract on the Sale of Property if no preliminary contract is signed.

For the commission charged Nekretnine Sunce d. o. o. issues an invoice to the Seller.

Once we establish contact between the seller selling a property and the buyer wishing to buy the property, an agency contract for sale of real property is signed between the buyer and Nekretnine Sunce d.o.o. and conditions for the acquisition of the property (sales price, method of payment of sales price, entering into possession and other details) are agreed .

Nekretnine Sunce d. o. o. has an obligation:

- to submit a proof of property ownership to the buyer,
- to draft a preliminary contract and the contract on the sale of property,
- to organise certification of signatures by the seller and the buyer at the notary public,
- if the sales price is paid with a bank loan, an employee of Nekretnine Sunce d.o.o. is present at the notarisation of the Loan Contract at a notary public, and then, based on the power of attorney issued by the buyer, he submits the application to register the mortgage to the Land Register of the Municipal Court,
- an employee of Nekretnine Sunce d. o. o. is present during the payment of the sales price and the acceptance of the property, and on that occasion the Real Estate Acceptance Protocol is drafted.

Based on the buyer's power of attorney Nekretnine Sunce d. o. o. renders the following services to the buyer:
a) we submit a tax declaration to the Tax Administration and we are present at the property valuation by the commission of the Tax Administration,
b) once the buyer makes payment of the property sales tax, an employee of Nekretnine Sunce d. o. o. takes the Contracts on the Sale of Property to the Tax Administration in order for it to be endorsed with a stamp stating that the tax is paid or that a buyer is fully or partially exempt from the property sales tax,
c) an employee of Nekretnine Sunce d. o. o. submits valid documentation to the utilities (Elektra, Plinara, Stambeno komunalno gospodarstvo, Toplinarstvo) in order for the utility bills (electricity, gas, waste disposal, district heating) to be transferred to the buyer.
d) an employee of Nekretnine Sunce d. o. o. submits the contract on the sale of property to the land registry of the competent municipal court with an application to register the ownership to the name of the buyer.

For the agency services rendered Nekretnine Sunce d. o. o. charges a commission from the seller amounting to 1.5% + VAT of the agreed sales price on the territory of the City of Zagreb and the County of Zagreb and 2% + VAT for properties outside the City of Zagreb and the County of Zagreb. For the commission charged Nekretnine Sunce d. o. o. issues an invoice to the Seller.


Property Letting and Renting - Terms and Conditions


If a lessor wishes Nekretnine Sunce d.o.o. to provide agency services for leasing a property, our agent visits the property and inspects the documentation, and he agrees the rent for the property and other details in connection with the property lease with the lessor. After that an agency contract is signed with the lessor. If the seller agrees, we take photos of the property in order to be able to present it efficiently to potential lessees.

Nekretnine Sunce d. o. o. has an obligation:

- to dilligently inform the lessor about agency opportunities with potential lessees,
- to conduct negotiations in order to reach an agreement on leasing the property,
- once the agreement is reached, to draft a lease contract,
- to organise certification of the seller's and buyer's signatures on the lease contract,
- to submit, based on the lessor's power of attorney, a tax declaration to the Tax Administration,
- our employee is present during the acceptance of the property, and at the time when the lessee enters and leaves the property, and on that occasion the Real Estate Acceptance Protocol is drafted.

For property lease agency services Nekretnine Sunce d. o. o. charges a commission from the lessor:

- amounting to one monthly rent if the lease agreement is concluded for the period of 5 (five) years,
- amounting to one and a half monthly rent if the lease agreement is concluded for a period of more than 5 (five) years,
in either case within 8 (eight) days from the date of the conclusion of the lease agreement between the lessor and the lessee. The VAT is included in the commission.

Nekretnine Sunce d. o. o. issues an invoice for the commission charged.
